
CONTRACT
1. Creative Wedding Films (also known as Squarebox Media Pty Ltd) will deliver according to all items described in the client's chosen package and any additional items agreed upon via email correspondence or supplied questionnaire.
2. The delivered photos / videos are strictly produced for the client’s non-commercial use only and must not be re-sold. Copyright of the works are retained by Creative Wedding Films and works can be exploited by Creative Wedding Films for promotional purposes, and as physical prints purchasable by the client only.
3. A deposit is required to secure your wedding date. In the event of a cancellation or termination for any reason, the deposit is non-refundable, as it compensates for potential loss of income from other prospective bookings on that date.
If cancellation occurs within three months of the wedding date, an invoice will be issued for 50% of the total quote (minus the deposit), due to lost income and the unlikelihood of rebooking at such late notice.
If there is no cancellation, the deposit will be applied toward your final bill. The remaining balance must be paid at least seven days before the wedding, unless we have agreed on a different arrangement or payment extension. If payment in full is not received 48 hours prior to the wedding date, we may attempt to charge the outstanding amount to the same card used for the deposit if Stripe was the original payment method. We do not store your card details; Stripe securely holds your payment information.
Please note that our photographers and videographers will not attend the wedding unless payment has been made in full. Should additional coverage be required on the day, a separate invoice will be issued afterward. Final videos will not be delivered until all payments have been received.
4. The client shall arrange for meals to be provided to Creative Wedding Films.
5. It is the responsibility of the client to secure permission of shooting locations. Camera placements are chosen on the basis of best avoiding standing in front of guests or blocking their sight of view and hence this may affect the angles and/or quality of the final product and will not constitute grounds for a refund.
6. Creative aspects such as shooting and editing styles are at the discretion of Creative Wedding Films, unless requested otherwise in writing prior to the wedding date.
7. Any problems caused by running behind in schedule may result in missing footage and / or photos. If this is caused by poor planning, misguided directions, traffic conditions or poor time management, it will not constitute grounds for a refund. It is the client's sole responsibility to inform Creative Wedding Films of any specific needs or changes in events.
8. In the unlikely event the client is not satisfied with the final product due to missing footage as a result of an error from Creative Wedding Films, a partial refund can be requested but the refund will only be apportioned to the amount of footage missing, not a full refund. For instance, if it is missing footage from one part of the day, and the day is divided into 5 parts, then a 20% refund would be issued. Beyond this, subjective criticism to the final product will not be grounds to constitute any refund, however, Creative Wedding Films will follow any reasonable requests to amend the final product to address the clients concerns in good faith.
9. Creative Wedding Films will not be held liable for any problems beyond our control e.g., bad weather, power failure, non-functioning internet, accidents, poor acoustics/lighting, interference from guests & other photographers or vendors etc. poor health, theft, vandalism or terrorism.
10. Creative Wedding Films reserves the right to terminate this contract at any time for any reasonable cause. In this event, all monies will be refunded in full. Any liability on the part of Creative Wedding Films will be limited to the amount of monies paid.
11. Upon taking possession of the finished product, the client must inform Creative Wedding Films of any technical or other problems with the videos within 7 days. After 7 days, if no notification has been received, the client will be deemed satisfied with the product.
12. Final delivery of the photos / video can be expected between 3 to 12 weeks after the event. The completion period is only an approximate length of time and any longer periods necessary for completion will not void this contract.
13. Any copyrighted music requested from the client and used in the videos will be at the clients responsibility for clearance of use.
14. Any editing changes to the delivered product requested by the client is limited to one set of changes free of charge. Any additional editing changes beyond this will be charged at a rate of $150 (one hundred and fifty dollars) per hour.
15. Protection of Deliverables / Retention of Files. Creative Wedding Films shall take all reasonable steps to protect the files recorded at the event until such time as the final products are delivered to the client. Once the final products are delivered to the client, Creative Wedding Films have no further obligation to preserve those files, regardless of the form of media in which they are stored. However, the protocol in place is that Creative Wedding Films do keep a copy of the final highlight film and edited photos on cloud storage. All other files are discarded after 3 months.
